This website is operated by Biospear Ltd (“we/us”). As a user of this website you acknowledge that any use of this website including any transactions you make is subject to the terms and conditions set out below.

Please read through these terms and conditions carefully before using this website.

ORDERING

All orders that you place on this website will be subject to acceptance of these terms and conditions.

Acceptance of your order and completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it.

We may refuse to accept an order:

(a) where goods are not available;

(b) where we cannot obtain authorisation for your payment;

(c) if there has been a pricing or product description error;

(d) if your delivery address is outside mainland UK: or

(e) if you do not meet any eligibility criteria set out in our terms and conditions.

PRODUCT SPECIFICATIONS AND SUITABILITY

Published product details, specifications and suitability information is the best available at the time. We shall not be held responsible for the accuracy of any advice given regarding the suitability (or otherwise) of any products.

PRICES AND PAYMENT

Prices shown in green on this website are inclusive of VAT. Any applicable carriage is payable by the customer in addition to the displayed price.

Payments are made via Worldpay. We undertake not to take or retain any details of your credit or debit cards at any time during your use of this website.

Payment will be taken from your card at the time we receive your order.

Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.

We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

DELIVERY

Delivery will be made to the billing address supplied by you at checkout, unless you specify a separate delivery address.

For each order placed, there is a delivery charge calculated based on the weight of the products (exclusive of VAT) for products under the value of £75 (exclusive of VAT). For orders over £75 (exclusive of VAT), delivery is free.

Please allow up to 5 working days for delivery. We make every effort to deliver goods within the estimated timescales, however, delays are sometimes inevitable due to unforeseen factors. We shall be under no liability for any delay or failure to deliver the products within estimated timescales. If we anticipate any delivery taking longer than expected we will notify you by email.

CANCELLATION

You may cancel your order in accordance with your rights under the Distance Selling Regulations. Under the Distance Selling Regulations you have a right to cancel your order for any item purchased within 7 days of receipt of goods, for a refund. To cancel you must contact us within 7 days of delivery of your items, quoting full order details. All goods must be unopened and in perfect condition. We unconditionally reserve the right not to refund if the goods are not returned in perfect condition. If your goods have not been dispatched, we will arrange for a refund to the card you used to purchase the goods. If your order has been dispatched, you will be charged for the cost of carriage on the original delivery.

RETURNS

Our aim is to ensure your order reaches you in perfect condition and on time. In the unlikely event of your delivery being incorrect (for example faulty, incorrect or damaged deliveries), please follow these guidelines so that we can rectify matters without delay:

Check the delivery upon receipt and sign for the goods.

If there is a problem, note it on the delivery document, then sign it and ask the driver to countersign.

Contact our Customer Service Team by email (admin@biospear.co.uk)who will provide you with further instructions.

Goods must not be returned until authorised by our Customer Service Team.

If you are unable to check or count the delivery upon receipt, please sign it as being unchecked and check the goods within three days, advising our Customer Service Team of any problems immediately.

PRIVACY

We will never sell or pass on your name and address to any other organisation without your consent. Your details are confidential and you will never receive unsolicited mail from third parties as a result of ordering from us.

We maintains a strict privacy policy in full accordance with the Data Protection Act 1998.

Unless otherwise stated, all rights, including copyright, in the content of this website are owned and controlled by Biospear  Limited.

In accessing these web pages, you agree that you may only download the content for your own individual and non-commercial use.

You are not permitted to copy, download, store, transmit, adapt or change in any way the content of this website for any other purpose whatsoever, in any medium, without the prior written permission of Biospear Limited.

LIABILITY

We shall not be liable for incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third party claims.

We will do our best to get all orders dispatched as quickly as possible. We have no liability to you for any delay in the delivery of products ordered. You have the right to cancel delayed orders at any time and get a refund prior to the item being dispatched.

REFUND POLICY

We do not offer refunds on our products as it is a consumable item. If goods are damaged in transit we require notification within 24 hours of receipt of goods and we will dispatch replacements for any any damaged items within 3 working days. Please send request for replacement together with details of damage ( photo if possible) to info@biospear.co.uk
